Please read these terms carefully. By accessing this website, purchasing services or participating in training with End Rezults Fitness LLC (“End Rezults Fitness” or “ERF”), you agree to these terms. If you do not agree, do not use the website or purchase or receive ERF services.
The website and services are intended for adults age 18 or older. A parent or legal guardian must approve participation by a minor.
Terms and Conditions of Use
These Terms of Use apply to erzfitness.com and associated ERF software and services. Website content is provided for general information and does not replace individualized medical advice. ERF may update website content, offerings and these terms from time to time. The version posted on this page governs website use from its stated update date.
Submitting Information
You may submit information through the website to request services, make a purchase or communicate with ERF. By submitting information, you authorize ERF to use it for the purpose provided and as described in applicable privacy practices.
You represent that any material you submit is accurate, lawful and does not infringe another person’s rights. ERF may remove content that violates these terms and is not responsible for unsolicited or third-party content.
Client Picture Release Agreement
Photos or videos taken by ERF may be used for progress tracking. Public use—including websites, printed marketing and social media—requires the client’s permission. Clients may decline public use or withdraw future permission by notifying their trainer in writing. Declining public use does not affect access to training services. Images not approved for public use will remain private within ERF’s client records, subject to normal record-retention practices.
Personal Training Agreement
ERF provides science-based personal training and coaching designed to help clients pursue their goals. Progress also depends on the client’s attendance, effort, recovery, nutrition and adherence to programming during supervised and unsupervised days. Specific outcomes cannot be guaranteed.
Health and medical readiness
Exercise carries inherent risks, including cardiovascular stress, falls and musculoskeletal injury. Clients must disclose known injuries, medical conditions, medications and physical limitations that may affect safe participation, and promptly report material changes.
A physician’s evaluation is recommended for anyone with exercise restrictions, significant medical risk factors, recent serious injury or illness, or other concerns about exercise participation. When appropriate, ERF may request medical clearance before training continues. ERF coaches do not diagnose or treat medical conditions.
Scheduling, Cancellations and Makeups
Recurring appointments
Training is generally scheduled as a recurring appointment on the same day, time and location. Rescheduling is subject to trainer availability and ERF’s discretion.
24-hour cancellation policy
A session must be cancelled or rescheduled at least 24 hours in advance. Late cancellations and no-shows result in forfeiture of the session, except when ERF approves a limited courtesy accommodation for sudden illness or an emergency communicated as soon as reasonably possible.
Late arrivals and trainer delays
A client who arrives late receives the remaining scheduled session time. ERF trainers allow a 15-minute grace period. If a trainer is more than 15 minutes late, ERF will arrange replacement time or an equivalent service at no additional cost.
Makeup-session limits
Makeups are based on sessions missed, not weeks missed. A 4-session package allows up to 1 makeup, an 8-session package allows up to 2, and a 12-session package allows up to 3 during the applicable monthly or 30-day billing cycle. Approved makeups must generally be completed within that same cycle and may be delivered virtually when appropriate.
A session cancelled by ERF will be rescheduled and does not reduce the client’s makeup allowance. For group training, a group session is rescheduled only when the entire group can reschedule together.
Session use and expiration
Packages cover a 30-day service period. Sessions must be used during that period and do not roll over, except for an ERF-approved makeup or trainer-cancelled session. Unused or expired sessions are not converted to cash or account credit.
Payments, Recurring Billing and Cancellation
Package payments
Training packages are prepaid and all sales are final. Package rates and included sessions are shown at purchase or in the client’s billing notice.
Stored payment authorization
When a client completes ERF’s Square authorization, the client authorizes Square to securely store the selected payment method and authorizes ERF to charge that method for the recurring training package, disclosed transition adjustments, approved additional services and agreed package changes.
Recurring charges process monthly on the client’s assigned billing date—the 1st or 15th. ERF provides the applicable amount through a billing notice and/or Square invoice before processing and provides a receipt after payment. No separate reminder is required for a regular charge that matches the agreed package and billing arrangement.
ERF will provide advance notice before changing the regular package rate or recurring billing date. A declined payment or removed payment method does not cancel services or eliminate an outstanding balance.
Cancellation of recurring service
Recurring-service cancellation must be submitted in writing at least 30 days before the next scheduled payment date. The authorization remains effective until properly withdrawn in writing. Removing or replacing a stored payment method alone does not cancel the agreement. Amounts already due remain payable.
Assumption of Risk and Release
By participating, the client acknowledges the inherent risks of exercise and voluntarily assumes responsibility for injuries or damages arising from participation, to the fullest extent permitted by law. This includes risks related to ERF mobile equipment, third-party equipment, client-provided equipment, fitness evaluations, group exercise, and training at a home, business, facility or other selected location.
The client is responsible for providing a reasonably safe training area and disclosing known hazards. ERF and its officers, employees, contractors and representatives are released from liability for ordinary risks inherent in the activities, except where liability cannot legally be waived.
By purchasing or participating in ERF services, the client confirms that they have had an opportunity to review these policies, provide accurate health information and ask questions before participating.
